Italian Tax Scheme for investors in crypto assets based abroad

Italy offers a favorable tax regime for foreign investors, particularly those holding significant assets, including cryptocurrencies. Individuals residing abroad who, after relocating to Italy, exercise the options provided under Articles 24-bis (“new residents”) or 24-ter (“returning pensioners”) of the Italian Income Tax Code (TUIR) can benefit from favorable taxation on income from crypto assets.

Crypto Assets Taxation Advantages

Both regimes provide specific benefits for crypto investors:

  • Foreign-Sourced Crypto Income: Taxed at the favorable flat rate of €200,000 (new residents) or 7% (returning pensioners).
  • Exclusion of Italian-Sourced Crypto Income: Standard tax rates apply only to income generated within Italy.
  • Comparison to Standard Crypto Taxation: Under regular Italian tax laws, crypto assets are subject to a 33% capital gains tax, making these regimes particularly beneficial for high-net-worth crypto holders.

For these individuals based abroad Italy, income from crypto assets, if (and only if) sourced from abroad, is taxed either at a flat rate of €200,000 or with a substitute tax of 7%.

These regimes present undeniable advantages compared to the 33% tax rate imposed by Italian legislation on cryptocurrency income:

  • In the first case (flat tax 200K), if the “crypto portfolio” of the new resident is particularly profitable (since the effective tax rate decreases as income increases), and
  • in the second case (7%), because it allows beneficiaries to enjoy a tax rate nearly five times lower than the standard rate (33%).
