SR&ED Program Changes

SR&ED Is More Valuable in 2026

Recent changes to Canada’s SR&ED program have significantly expanded the incentive for businesses investing in research and development.

For taxation years beginning after December 15, 2024:

  • $6 Million Expenditure Limit

The maximum annual expenditure limit eligible for the enhanced 35% investment tax credit has increased to $6 million.

For qualifying businesses, that can represent up to $2.1 million in federal SR&ED ITCs on eligible expenditures.

  • Expanded Access for Growing Companies

The taxable-capital phase-out range associated with the enhanced expenditure limit has increased to $15 million–$75 million, expanding access for larger innovative businesses.

  • Capital Expenditures Are Back

Qualifying SR&ED capital expenditures made after December 15, 2024 may once again be eligible for SR&ED tax incentives.

  • Enhanced Credit for Eligible Canadian Public Corporations

Certain eligible Canadian public corporations may now qualify for the enhanced 35% SR&ED ITC on expenditures within their applicable limit.

FAQs

Frequently Asked Questions About SR&ED

What is the SR&ED tax credit?

Scientific Research and Experimental Development, or SR&ED, is a Canadian tax incentive program designed to encourage businesses to conduct research and development in Canada.

Eligible businesses can potentially claim a deduction against taxable income and earn an Investment Tax Credit based on qualifying SR&ED expenditures.

The federal SR&ED ITC generally ranges from 15% to 35% of qualifying expenditures depending on the type of claimant and applicable expenditure limit.

Certain eligible corporations can earn the enhanced 35% rate on up to $6 million of qualifying expenditures for taxation years beginning after December 15, 2024.

Projects involving scientific or technological uncertainty and a systematic process of experimentation or analysis may qualify.

SR&ED can apply across software, manufacturing, engineering, aerospace, life sciences, clean technology and many other industries.

Depending on your situation, qualifying expenditures may include salaries and wages, materials, certain contract expenditures, overhead and certain capital expenditures.

Potentially, yes. SR&ED eligibility is not dependent on achieving a commercially successful result. Experimental work undertaken to resolve technological or scientific uncertainty can potentially qualify even when the expected result is not achieved.

Leyton supports clients throughout the claim process, including responding to CRA questions and helping present the technical and financial documentation supporting the claim.

Ideally, SR&ED documentation should be considered while R&D projects are underway so that technical evidence, experimentation and eligible costs can be properly captured.
